These Terms of Service (“Terms”) govern your access to and use of the Creditable website, platform, and related services (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.
1. About Creditable
Creditable LLC (“Creditable,” “we,” “us,” or “our”) is a Missouri limited liability company that provides software tools designed to assist organizations with plan-level creditable coverage testing and related compliance analysis.
2. Scope of These Terms
These Terms apply to:
Visitors to our website
Prospective customers and leads
Users who access the Services before creating an account
If you become a registered user or customer, your use of the platform is also governed by:
Our User Agreement, and
Any Service Agreement you execute with Creditable
In the event of a conflict, the User Agreement or Service Agreement will control.
3. Privacy
Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and protect information. By using the Services, you consent to those practices.
4. Eligibility
You must be at least 18 years old to use the Services and must have the legal authority to agree to these Terms.
5. Acceptable Use
You agree not to:
Use the Services for unlawful or fraudulent purposes
Attempt to gain unauthorized access to systems or data
Interfere with or disrupt the Services
Reverse engineer, scrape, or copy site content or software
Upload malicious code
Misrepresent your identity or affiliation
Creditable may suspend or terminate access for violations.
6. Intellectual Property
All content, software, trademarks, logos, and materials available through the Services are owned by or licensed to Creditable and are protected by intellectual property laws.
You may not copy, modify, distribute, or create derivative works without prior written permission.
7. No Professional Advice
The Services provide informational and analytical tools only.
Creditable does not provide:
Legal advice
Actuarial certification
ERISA guidance
Fiduciary services
You are solely responsible for determining compliance with applicable laws.
8. No PHI / HIPAA Disclaimer
Creditable does not collect, store, or process Protected Health Information (“PHI”) under HIPAA.
You agree not to upload PHI or individual medical information to the Services.
9. Third-Party Links
The Services may contain links to third-party websites. Creditable is not responsible for the content or privacy practices of those sites.
10. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREDITABLE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREDITABLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.
CREDITABLE’S TOTAL LIABILITY ARISING FROM THESE TERMS SHALL NOT EXCEED $100, OR THE AMOUNT YOU PAID (IF ANY), WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify and hold harmless Creditable from claims, damages, losses, or expenses arising from:
Your use of the Services
Your violation of these Terms
Your violation of any law or third-party rights
13. Termination
Creditable may suspend or terminate access to the Services at any time for violations of these Terms or for lawful reasons.
14. Governing Law
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.
15. Changes to These Terms
Creditable may update these Terms from time to time. Updated Terms will be posted with a revised “Last Updated” date. Continued use constitutes acceptance.
